Terms of Service

These terms govern your use of Nyxialith OS, operated by Heiko Trenkle. By using the service, you agree to these terms. Mandatory consumer rights remain unaffected.

1. The service

Nyxialith OS provides AI-assisted chat and creative tools. Preview features may change, be interrupted, or be withdrawn. AI output can be inaccurate, incomplete, or unsuitable; review it before relying on it.

2. Accounts

You sign in through a supported identity provider. You must be at least 18 years old, or have the consent of a legal guardian where permitted. Keep access to your identity provider and connected wallet secure. You are responsible for activity performed through your account.

3. Catnip credits and payment

Catnip is a closed service credit used only to obtain Nyxialith digital services. It is not money, a cryptocurrency, an investment, or redeemable for cash. Prices and the exact payment asset amount are shown before purchase. Catnip does not expire while your account remains active.

Crypto transfers are technically irreversible. This does not limit statutory withdrawal, refund, or defect remedies. Our Refund and Withdrawal Policy explains how to exercise them.

4. Your content and generated output

You retain rights you already hold in prompts and uploads. You grant us the limited rights needed to host, transmit, process, and display that content to operate the service. Subject to applicable law and third-party rights, we assign to you any rights we may hold in output generated specifically for you.

You must have the rights needed for anything you upload. Do not use the service to violate law, privacy, intellectual-property rights, or the safety of others. Output may resemble material created for other users and is not guaranteed to be unique or protectable.

5. Acceptable use

Do not abuse, disrupt, probe, scrape, reverse engineer, evade limits, automate excessive requests, impersonate others, distribute malware, or create illegal or seriously harmful material. We may limit or suspend access where reasonably necessary to protect users, providers, or the service.

6. Availability and changes

We aim to provide the service with reasonable care but do not promise uninterrupted availability. We may update models, features, limits, and these terms. Material changes apply prospectively and will be communicated in a reasonable way.

7. Liability

We are liable without limitation for intent, gross negligence, injury to life, body or health, fraudulently concealed defects, and liability required by law. For slight negligence, we are liable only for breach of essential contractual duties and only for foreseeable, typical damage. Mandatory product and consumer liability remains unaffected.

8. Ending the agreement

You may stop using the service and delete your account at any time from the account menu. Deletion removes access and erases workspace data, subject to legally required retention. Remaining Catnip is handled under the Refund Policy.

9. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not remove mandatory protections of the country where you habitually reside.
